ARTICLE 1 – CHAMP D’APPLICATION – ACCEPTATION
1.1 Les présentes conditions générales sont applicables à toutes les commandes de services, ci-après « les services », passées avec la SRL Wild Impulse établie à Rue Bois Eloi 27, 1380 Lasne, ci-après dénommée Wild Impulse, et particulièrement à l’organisation d’événements sportifs outdoor, notamment des activités de trail, packraft, VTT et autres disciplines en milieu naturel.
1.2 Toute commande confirmée implique l'acceptation pleine et entière des présentes conditions générales.
1.3 Les présentes conditions constituent l’intégralité des relations contractuelles entre parties.
1.4 Elles sont consultables à tout moment sur www.sovageraid.com et validées lors de l’inscription.
1.5 Le client est réputé en avoir pris connaissance lors de son inscription.
ARTICLE 2 – INSCRIPTIONS ET TICKETING
2.1 L’inscription et/ou la vente de tickets s’effectue via le site de l’événement ou via un lien fourni par l’organisateur.
2.2 La date limite d’inscription est fixée par l’organisateur et dépend des places disponibles.
3.1 Les factures liées à des contrats spécifiques (sponsoring, partenariats, etc.) sont soumises aux conditions prévues dans ces contrats.
4.1 Tous les prix sont exprimés en euros et soumis à la TVA belge.
5.1 Une facture est envoyée par email à la personne de contact.
5.2 Le paiement est exigible immédiatement.
5.3 Tout retard de paiement de plus de 7 jours entraîne un intérêt de 1 % par mois.
5.4 Des frais de rappel de 12,50 € peuvent être appliqués.
5.5 Toute contestation doit être faite dans les 8 jours à : info@sovageraid.com.
5.6 En cas de paiement en ligne, une confirmation est envoyée immédiatement.
ARTICLE 6 – ANNULATION – INDEMNITÉ
6.1 En cas d’annulation par le participant, aucun remboursement ne sera effectué, sauf mention contraire.
6.2 En cas de non-paiement, l’inscription est annulée automatiquement.
6.3 En cas de non-participation, quelle qu’en soit la raison, y compris à la suite d’une modification du programme dans les conditions prévues à l’article 10.3, le participant ne peut réclamer le remboursement du montant de l’inscription ou du ticket, sous réserve des dispositions légales impératives applicables.
ARTICLE 7 – RESPONSABILITÉ – ASSURANCES
7.1 Les activités outdoor comportent des risques liés à l’environnement naturel, au terrain et aux conditions météorologiques.
Le participant déclare être en bonne santé, apte physiquement et techniquement, et savoir nager pour les activités nautiques.
7.2 La participation se fait aux risques du participant.
7.3 Le participant doit respecter les consignes de sécurité.
7.4 Il reconnaît les risques inhérents aux activités outdoor, notamment les chutes, collisions, blessures, noyade, hypothermie et autres risques liés à la pratique sportive en milieu naturel.
7.5 Le participant doit être couvert par une assurance adaptée.
7.6 Wild Impulse n’est responsable qu’en cas de faute lourde ou intentionnelle, dans les limites autorisées par la législation applicable.
7.7 Le participant est responsable du matériel utilisé, prêté ou mis à sa disposition.
7.8 Wild Impulse n’est pas responsable de la perte, du vol ou des dommages occasionnés aux effets personnels.
8.1 L’événement se déroule dans un esprit sportif et respectueux.
8.2 Le respect de la nature, des sites traversés et des réglementations locales en vigueur est obligatoire.
8.3 Tout comportement dangereux, irrespectueux ou contraire aux valeurs de l’événement peut entraîner une exclusion sans remboursement.
9.1 Tout participant à l’événement est informé qu’il est susceptible d’être photographié et/ou filmé par les équipes Wild Impulse et/ou par tout tiers autorisé par Wild Impulse.
Par conséquent, il autorise expressément et gracieusement la captation de son image par tout moyen et l'exploitation de son image sur tous supports (presse, affiche, prospectus, numérique, analogique, etc., sans limitation de quantité) et pour tous types de diffusion (télévision, site Internet, réseaux sociaux, etc.), par Wild Impulse et/ou par tout tiers autorisé par Wild Impulse.
La personne ayant effectué l’inscription pour le compte d’un ou plusieurs autres participants garantit à Wild Impulse avoir informé le(s) participant(s) des termes du présent article et avoir recueilli leurs consentements préalables.
ARTICLE 10 – FORCE MAJEURE – MODIFICATION DE L’ÉVÉNEMENT
10.1 Wild Impulse sera dégagée de toute responsabilité pour inexécution, exécution tardive ou imparfaite de ses obligations pour cause de force majeure ou de circonstances exceptionnelles indépendantes de sa volonté, pouvant notamment avoir pour conséquence l’annulation totale, partielle ou le report de l’Événement et l’obligeant de ce fait à annuler tout ou partie de l’événement.
À toutes fins utiles, seront notamment considérés comme des cas de force majeure, sans que cette liste soit limitative, les pandémies, épidémies, ainsi que toutes décisions visant à les combattre prises par les autorités gouvernementales, régionales, communales, provinciales, publiques, administratives ou judiciaires, s’imposant à Wild Impulse et ayant un impact sur l’organisation de l’événement.
Seront également considérés comme des cas de force majeure et sans que cette liste soit limitative, l’inondation, l’incendie, les intempéries ou conditions météorologiques de toute nature (telles que pluie, vent, grêle, tempête, orage, foudre, typhon, humidité, canicule ou chaleur extrême) de nature à interrompre, modifier ou annuler l’événement, la grève des transports, une recommandation de l’OCAM en cas d’attentat ou de menace d’attentat.
10.2 Wild Impulse s’engage à notifier promptement tout événement de force majeure imposant de modifier ou rendant impossible l’organisation ou la tenue de l’événement.
Lorsque le contrat est résolu pour cause de force majeure et que la résolution est notifiée, Wild Impulse se réserve le droit de proposer aux personnes concernées, en lieu et place du remboursement du prix de leurs billets, un avoir d’un montant égal, dans les limites autorisées par la législation applicable.
10.3 – Modification ou remplacement d’une discipline
Lorsque, pour des raisons indépendantes de la volonté de Wild Impulse, une ou plusieurs disciplines initialement prévues dans le programme de l’événement ne peuvent être organisées ou maintenues dans des conditions satisfaisantes de sécurité ou conformément aux autorisations applicables, Wild Impulse se réserve le droit de modifier, raccourcir, neutraliser ou supprimer la discipline concernée et, dans la mesure du possible, de la remplacer par une autre activité ou discipline.
Sont notamment visées, sans que cette liste soit limitative, les conditions météorologiques ou naturelles défavorables, la sécheresse, un niveau d’eau insuffisant ou excessif, un débit d’eau inadapté, les risques d’incendie, l’état ou l’impraticabilité des parcours, chemins ou plans d’eau, les décisions ou recommandations des autorités publiques, gestionnaires de sites ou propriétaires, ainsi que le retrait ou la modification d’une autorisation nécessaire à l’organisation d’une discipline.
Lorsque l’événement est néanmoins maintenu, la modification, le remplacement ou la suppression d’une discipline pour l’une de ces raisons ne constitue pas une annulation de l’événement.
Le participant qui décide de ne pas prendre part à l’événement en raison d’une telle modification, d’un tel remplacement ou d’une telle suppression ne pourra prétendre au remboursement, total ou partiel, de son inscription, sous réserve des dispositions légales impératives applicables aux consommateurs.
11.1 L’illégalité ou la non-validité d’une des clauses prévues dans les présentes conditions générales n’entraîne aucunement la nullité des autres clauses contractuelles.
ARTICLE 12 – LITIGES – COMPÉTENCE – DROIT APPLICABLE
12.1 En cas de différend relatif à la formation, l’interprétation, l’exécution ou la résolution des présentes conditions générales, les parties s’efforceront de rechercher une solution amiable.
12.2 Les relations contractuelles entre les parties auxquelles s’appliquent les présentes conditions générales sont régies et interprétées conformément au droit belge.
12.3 Les tribunaux de l’arrondissement judiciaire du siège de Wild Impulse sont compétents, sans préjudice des droits reconnus au consommateur par la législation applicable.
ARTICLE 13 – PROTECTION DES DONNÉES PERSONNELLES (RGPD)
13.1 Dans le cadre de l’organisation des événements et de la gestion des inscriptions, Wild Impulse est amenée à collecter et traiter des données à caractère personnel concernant les participants, notamment nom, prénom, adresse email, numéro de téléphone et informations liées à la participation.
13.2 Ces données sont traitées conformément au Règlement (UE) 2016/679 du 27 avril 2016 (RGPD) ainsi qu’à la législation belge applicable.
13.3 Les données collectées sont utilisées exclusivement pour :
● la gestion des inscriptions et de la participation aux événements ;
● la communication d’informations relatives à l’événement ;
● la gestion administrative et financière ;
● l’amélioration des services proposés.
13.4 Les données personnelles sont conservées pendant une durée n’excédant pas celle nécessaire aux finalités pour lesquelles elles sont collectées, sauf obligation légale contraire.
13.5 Wild Impulse s’engage à mettre en œuvre toutes les mesures techniques et organisationnelles appropriées afin de garantir la sécurité et la confidentialité des données personnelles.
13.6 Les données personnelles ne sont pas transmises à des tiers, sauf lorsque cela est nécessaire à l’organisation de l’événement (prestataires techniques, partenaires) ou en cas d’obligation légale.
13.7 Conformément au RGPD, toute personne concernée dispose notamment des droits d’accès, de rectification, d’effacement, de limitation du traitement, d’opposition et de portabilité des données.

13.8 Toute personne concernée peut introduire une plainte auprès de l’Autorité de protection des données (APD) en Belgique.
ARTICLE 14 – SÉCURITÉ ET CONDITIONS DE PARTICIPATION
14.1 Wild Impulse se réserve le droit de refuser la participation ou d’exclure à tout moment un participant dont le niveau physique ou technique est jugé insuffisant, dont l’équipement est inadapté ou non conforme, ou dont le comportement est susceptible de mettre en danger sa propre sécurité ou celle des autres participants.
14.2 Aucun remboursement ne pourra être réclamé en cas d’exclusion pour l’un des motifs visés au présent article, sous réserve des dispositions légales impératives applicables.
14.3 Le participant s’engage à disposer de l’équipement obligatoire requis pour l’événement, tel que précisé dans les informations communiquées par Wild Impulse avant l’événement.
ARTICLE 15 – RECONNAISSANCE DES RISQUES ET RESPONSABILITÉ DU PARTICIPANT
15.1 Le participant reconnaît expressément que les activités proposées par Wild Impulse, notamment le trail, le packraft, le VTT et toute autre activité en milieu naturel, comportent des risques inhérents pouvant entraîner des dommages matériels, des blessures, des blessures graves, voire le décès.
15.2 En validant son inscription, le participant déclare :
● être en bonne condition physique et ne présenter aucune contre-indication connue à la pratique des activités auxquelles il s’inscrit ;
● disposer des compétences techniques minimales requises ;
● savoir nager pour toute activité impliquant un milieu aquatique ;
● être conscient des risques inhérents à ce type d’événement.
15.3 Le participant accepte les risques inhérents et normalement prévisibles liés à sa participation et reconnaît participer sous sa propre responsabilité pour les conséquences résultant de son propre comportement, de son état de santé, de son équipement ou du non-respect des consignes de sécurité. La présente disposition n’a ni pour objet ni pour effet d’exclure ou de limiter une responsabilité de Wild Impulse qui ne pourrait légalement être exclue ou limitée.
15.4 Le participant s’engage à respecter l’ensemble des consignes de sécurité communiquées avant et pendant l’événement ainsi que les décisions prises par l’organisation, notamment en cas de modification du parcours ou d’arrêt d’une activité pour des raisons de sécurité.
15.5 Le participant reconnaît que Wild Impulse peut être amenée à modifier, interrompre ou supprimer tout ou partie d’un parcours ou d’une discipline pour des raisons de sécurité, conformément notamment aux dispositions de l’article 10.
15.6 Le participant est responsable de son matériel personnel ainsi que du matériel mis à sa disposition par Wild Impulse. Il s’engage à l’utiliser conformément aux instructions reçues et à en prendre raisonnablement soin.
15.7 En validant son inscription en ligne et en acceptant les présentes conditions générales, le participant reconnaît avoir pris connaissance des risques inhérents aux activités proposées ainsi que des obligations de sécurité prévues au présent article.

ARTICLE 1 – SCOPE – ACCEPTANCE
1.1 These general terms and conditions apply to all orders for services, hereinafter referred to as the “Services”, placed with Wild Impulse SRL, established at Rue Bois Eloi 27, 1380 Lasne, hereinafter referred to as “Wild Impulse”, and in particular to the organisation of outdoor sporting events, including trail running, packrafting, mountain biking and other activities conducted in natural environments.
1.2 Any confirmed order entails full and unconditional acceptance of these general terms and conditions.
1.3 These general terms and conditions constitute the entire contractual agreement between the parties.
1.4 They may be consulted at any time at www.sovageraid.com and must be accepted during the registration process.
1.5 The customer is deemed to have read and understood them upon registration.
ARTICLE 2 – REGISTRATION AND TICKETING
2.1 Registration and/or ticket sales take place through the event website or via a link provided by the organiser.
2.2 The registration deadline is determined by the organiser and is subject to availability.
ARTICLE 3 – INVOICING
3.1 Invoices relating to specific agreements, including sponsorship and partnership agreements, are subject to the terms and conditions set out in those agreements.
ARTICLE 4 – PRICES
4.1 All prices are stated in euros and are subject to Belgian VAT.
ARTICLE 5 – PAYMENT
5.1 An invoice is sent by email to the contact person.
5.2 Payment is due immediately.
5.3 Any payment overdue by more than seven days shall incur interest at a rate of 1% per month.
5.4 A reminder fee of €12.50 may be charged.
5.5 Any dispute must be submitted within eight days by email to: info@sovageraid.com.
5.6 In the case of online payment, confirmation is sent immediately.
ARTICLE 6 – CANCELLATION AND COMPENSATION
6.1 In the event of cancellation by the participant, no refund shall be issued unless otherwise stated.
6.2 In the event of non-payment, the registration shall be cancelled automatically.
6.3 In the event of non-participation, for any reason whatsoever, including following a change to the programme under the circumstances set out in Article 10.3, the participant may not claim a refund of the registration fee or ticket price, subject to any applicable mandatory provisions of law.
ARTICLE 7 – LIABILITY AND INSURANCE
7.1 Outdoor activities involve risks associated with the natural environment, the terrain and weather conditions.
The participant declares that they are in good health, physically and technically capable of participating, and able to swim in the case of water-based activities.
7.2 Participation is at the participant’s own risk.
7.3 The participant must comply with all safety instructions.
7.4 The participant acknowledges the risks inherent in outdoor activities, including falls, collisions, injuries, drowning, hypothermia and other risks associated with sporting activities conducted in natural environments.
7.5 The participant must be covered by appropriate insurance.
7.6 Wild Impulse shall only be liable in the event of gross negligence or wilful misconduct, within the limits permitted by applicable law.
7.7 The participant is responsible for any equipment used, borrowed or made available to them.
7.8 Wild Impulse shall not be liable for the loss or theft of, or damage to, personal belongings.
ARTICLE 8 – CONDUCT AND VALUES
8.1 The event shall take place in a spirit of sportsmanship and mutual respect.
8.2 Respect for nature, the locations through which the event passes and all applicable local regulations is mandatory.
8.3 Any dangerous or disrespectful behaviour, or any behaviour contrary to the values of the event, may result in exclusion without a refund.
ARTICLE 9 – IMAGE RIGHTS
9.1 Every participant in the event is informed that they may be photographed and/or filmed by Wild Impulse’s teams and/or by any third party authorised by Wild Impulse.
The participant therefore expressly authorises, free of charge, the recording of their likeness by any means and the use of their likeness in any medium, including the press, posters, brochures and digital or analogue media, without limitation as to quantity, and through any form of distribution, including television, websites and social media, by Wild Impulse and/or by any third party authorised by Wild Impulse.
Any person who completes the registration on behalf of one or more other participants warrants to Wild Impulse that they have informed the participant or participants of the provisions of this article and obtained their prior consent.
ARTICLE 10 – FORCE MAJEURE AND MODIFICATION OF THE EVENT
10.1 Wild Impulse shall be released from liability for any failure, delay or defective performance of its obligations due to force majeure or exceptional circumstances beyond its control. Such circumstances may, in particular, result in the total or partial cancellation or postponement of the event and may consequently require Wild Impulse to cancel all or part of the event.
For the avoidance of doubt, events of force majeure shall include, without limitation, pandemics and epidemics, as well as any measures intended to combat them that are adopted by governmental, regional, municipal, provincial, public, administrative or judicial authorities, are binding on Wild Impulse and affect the organisation of the event.
Events of force majeure shall also include, without limitation, floods, fires, adverse weather or weather conditions of any kind—including rain, wind, hail, storms, thunderstorms, lightning, typhoons, humidity, heatwaves or extreme heat—that may interrupt, alter or cause the cancellation of the event, transport strikes, and any recommendation issued by the Belgian Coordination Unit for Threat Analysis (CUTA/OCAM) in the event of a terrorist attack or threat of a terrorist attack.
10.2 Wild Impulse undertakes to promptly notify the persons concerned of any event of force majeure that requires the event to be modified or makes its organisation or staging impossible.
Where the agreement is terminated due to force majeure and notice of termination has been given, Wild Impulse reserves the right to offer the persons concerned, instead of refunding the price of their tickets, a credit voucher of an equivalent value, within the limits permitted by applicable law.
10.3 – Modification or replacement of an activity
Where, for reasons beyond Wild Impulse’s control, one or more activities originally included in the event programme cannot be organised or maintained under satisfactory safety conditions or in accordance with the applicable authorisations, Wild Impulse reserves the right to modify, shorten, neutralise or remove the activity concerned and, where possible, replace it with another activity or sporting discipline.
Such circumstances include, without limitation, adverse weather or natural conditions, drought, insufficient or excessive water levels, unsuitable water flow, fire hazards, the condition or inaccessibility of routes, paths or bodies of water, decisions or recommendations issued by public authorities, site managers or property owners, and the withdrawal or amendment of an authorisation required for the organisation of an activity.
Where the event nevertheless goes ahead, the modification, replacement or removal of an activity for any of these reasons shall not constitute cancellation of the event.
A participant who decides not to take part in the event because of such a modification, replacement or removal shall not be entitled to a full or partial refund of their registration fee, subject to any applicable mandatory consumer protection provisions.
ARTICLE 11 – SEVERABILITY
11.1 If any provision of these general terms and conditions is found to be unlawful or invalid, this shall not affect the validity of or enforceability of the remaining contractual provisions.
ARTICLE 12 – DISPUTES, JURISDICTION AND APPLICABLE LAW
12.1 In the event of a dispute concerning the formation, interpretation, performance or termination of these general terms and conditions, the parties shall endeavour to reach an amicable settlement.
12.2 The contractual relationship between the parties to which these general terms and conditions apply shall be governed by and interpreted in accordance with Belgian law.
12.3 The courts of the judicial district in which Wild Impulse’s registered office is located shall have jurisdiction, without prejudice to any rights granted to consumers under applicable law.
ARTICLE 13 – PROTECTION OF PERSONAL DATA (GDPR)
13.1 In connection with the organisation of events and the management of registrations, Wild Impulse may collect and process participants’ personal data, including their surname, first name, email address, telephone number and information relating to their participation.
13.2 This data is processed in accordance with Regulation (EU) 2016/679 of 27 April 2016, the General Data Protection Regulation (“GDPR”), and applicable Belgian law.
13.3 The data collected is used exclusively for:
● managing registrations and participation in events;
● communicating information relating to the event;
● administrative and financial management;
● improving the Services provided.
13.4 Personal data shall not be retained for longer than is necessary for the purposes for which it was collected, unless otherwise required by law.
13.5 Wild Impulse undertakes to implement all appropriate technical and organisational measures to ensure the security and confidentiality of personal data.
13.6 Personal data shall not be disclosed to third parties unless this is necessary for the organisation of the event, including disclosure to technical service providers and partners, or is required by law.
13.7 In accordance with the GDPR, every data subject has, in particular, the rights of access, rectification, erasure, restriction of processing, objection and data portability.

13.8 Any data subject may lodge a complaint with the Belgian Data Protection Authority.
ARTICLE 14 – SAFETY AND CONDITIONS OF PARTICIPATION
14.1 Wild Impulse reserves the right to refuse participation or to exclude, at any time, any participant whose physical or technical ability is considered insufficient, whose equipment is unsuitable or non-compliant, or whose behaviour may endanger their own safety or that of other participants.
14.2 No refund may be claimed in the event of exclusion for any of the reasons referred to in this article, subject to any applicable mandatory provisions of law.
14.3 The participant undertakes to possess all mandatory equipment required for the event, as specified in the information provided by Wild Impulse before the event.
ARTICLE 15 – ACKNOWLEDGEMENT OF RISKS AND PARTICIPANT LIABILITY
15.1 The participant expressly acknowledges that the activities offered by Wild Impulse, including trail running, packrafting, mountain biking and any other activity conducted in a natural environment, involve inherent risks that may result in property damage, injury, serious injury or death.
15.2 By confirming their registration, the participant declares that they:
● are in good physical condition and have no known medical condition that would prevent them from participating in the activities for which they have registered;
● possess the minimum technical skills required;
● are able to swim in the case of any activity involving an aquatic environment;
● are aware of the risks inherent in this type of event.
15.3 The participant accepts the inherent and reasonably foreseeable risks associated with their participation and acknowledges that they participate at their own risk with regard to any consequences arising from their own conduct, state of health, equipment or failure to comply with safety instructions. This provision is neither intended nor shall have the effect of excluding or limiting any liability of Wild Impulse that cannot lawfully be excluded or limited.
15.4 The participant undertakes to comply with all safety instructions communicated before and during the event, as well as with decisions made by the organiser, including decisions to modify the route or stop an activity for safety reasons.
15.5 The participant acknowledges that Wild Impulse may be required to modify, interrupt or remove all or part of a route or activity for safety reasons, in accordance, in particular, with the provisions of Article 10.
15.6 The participant is responsible for their personal equipment and for any equipment made available to them by Wild Impulse. They undertake to use it in accordance with the instructions received and to take reasonable care of it.
15.7 By confirming their online registration and accepting these general terms and conditions, the participant acknowledges that they have been informed of the risks inherent in the activities offered and of the safety obligations set out in this article.

ARTIKEL 1 – TOEPASSINGSGEBIED – AANVAARDING
1.1 Deze algemene voorwaarden zijn van toepassing op alle bestellingen van diensten, hierna “de Diensten” genoemd, die worden geplaatst bij Wild Impulse SRL, gevestigd te Rue Bois Eloi 27, 1380 Lasne, hierna “Wild Impulse” genoemd, en in het bijzonder op de organisatie van outdoor-sportevenementen, waaronder trailrunning, packraften, mountainbiken en andere activiteiten in een natuurlijke omgeving.
1.2 Elke bevestigde bestelling houdt de volledige en onvoorwaardelijke aanvaarding van deze algemene voorwaarden in.
1.3 Deze algemene voorwaarden vormen de volledige contractuele relatie tussen de partijen.
1.4 Ze kunnen te allen tijde worden geraadpleegd op www.sovageraid.com en moeten bij de inschrijving worden aanvaard.
1.5 De klant wordt geacht er bij zijn inschrijving kennis van te hebben genomen.
ARTIKEL 2 – INSCHRIJVING EN TICKETING
2.1 De inschrijving en/of ticketverkoop gebeurt via de website van het evenement of via een link die door de organisator wordt verstrekt.
2.2 De uiterste inschrijvingsdatum wordt door de organisator bepaald en is afhankelijk van het aantal beschikbare plaatsen.
ARTIKEL 3 – FACTURATIE
3.1 Facturen die verband houden met specifieke overeenkomsten, waaronder sponsor- en samenwerkingsovereenkomsten, zijn onderworpen aan de voorwaarden die in deze overeenkomsten zijn opgenomen.
ARTIKEL 4 – PRIJZEN
4.1 Alle prijzen worden uitgedrukt in euro en zijn onderworpen aan de Belgische btw.
ARTIKEL 5 – BETALING
5.1 Een factuur wordt per e-mail naar de contactpersoon verzonden.
5.2 De betaling is onmiddellijk opeisbaar.
5.3 Bij een betalingsachterstand van meer dan zeven dagen is een rente van 1% per maand verschuldigd.
5.4 Er kunnen herinneringskosten van € 12,50 worden aangerekend.
5.5 Elke betwisting moet binnen acht dagen worden gemeld via: info@sovageraid.com.
5.6 Bij onlinebetaling wordt onmiddellijk een bevestiging verzonden.
ARTIKEL 6 – ANNULERING – VERGOEDING
6.1 Bij annulering door de deelnemer vindt geen terugbetaling plaats, tenzij anders vermeld.
6.2 Bij niet-betaling wordt de inschrijving automatisch geannuleerd.
6.3 Indien de deelnemer niet deelneemt, ongeacht de reden daarvoor, met inbegrip van een wijziging van het programma onder de in artikel 10.3 bepaalde voorwaarden, kan de deelnemer geen terugbetaling van het inschrijvingsbedrag of de ticketprijs eisen, onder voorbehoud van toepasselijke dwingende wettelijke bepalingen.
ARTIKEL 7 – AANSPRAKELIJKHEID – VERZEKERINGEN
7.1 Outdooractiviteiten houden risico’s in die verband houden met de natuurlijke omgeving, het terrein en de weersomstandigheden.
De deelnemer verklaart in goede gezondheid te verkeren, fysiek en technisch in staat te zijn om deel te nemen en te kunnen zwemmen wanneer hij deelneemt aan wateractiviteiten.
7.2 Deelname gebeurt op eigen risico van de deelnemer.
7.3 De deelnemer moet alle veiligheidsvoorschriften naleven.
7.4 De deelnemer erkent de risico’s die inherent zijn aan outdooractiviteiten, waaronder vallen, botsingen, verwondingen, verdrinking, onderkoeling en andere risico’s die verbonden zijn aan sportbeoefening in een natuurlijke omgeving.
7.5 De deelnemer moet over een passende verzekering beschikken.
7.6 Wild Impulse is uitsluitend aansprakelijk in geval van een zware of opzettelijke fout, binnen de grenzen die door de toepasselijke wetgeving zijn toegestaan.
7.7 De deelnemer is verantwoordelijk voor het materiaal dat hij gebruikt, dat hem wordt uitgeleend of dat hem ter beschikking wordt gesteld.
7.8 Wild Impulse is niet aansprakelijk voor verlies, diefstal of beschadiging van persoonlijke bezittingen.
ARTIKEL 8 – GEDRAG EN WAARDEN
8.1 Het evenement vindt plaats in een sportieve en respectvolle sfeer.
8.2 Respect voor de natuur, de doorkruiste locaties en de geldende plaatselijke regelgeving is verplicht.
8.3 Gevaarlijk of respectloos gedrag, of gedrag dat indruist tegen de waarden van het evenement, kan leiden tot uitsluiting zonder terugbetaling.
ARTIKEL 9 – PORTRETRECHT
9.1 Elke deelnemer aan het evenement wordt ervan in kennis gesteld dat hij mogelijk wordt gefotografeerd en/of gefilmd door de teams van Wild Impulse en/of door een derde die daartoe door Wild Impulse is gemachtigd.
De deelnemer verleent bijgevolg uitdrukkelijk en kosteloos toestemming om zijn afbeelding met alle mogelijke middelen vast te leggen en te gebruiken op alle dragers, waaronder de pers, affiches, brochures en digitale of analoge media, zonder beperking wat betreft het aantal, en voor alle vormen van verspreiding, waaronder televisie, websites en sociale media, door Wild Impulse en/of door een derde die daartoe door Wild Impulse is gemachtigd.
De persoon die de inschrijving voor rekening van een of meer andere deelnemers heeft verricht, garandeert tegenover Wild Impulse dat hij de deelnemer of deelnemers over de bepalingen van dit artikel heeft geïnformeerd en hun voorafgaande toestemming heeft verkregen.
ARTIKEL 10 – OVERMACHT – WIJZIGING VAN HET EVENEMENT
10.1 Wild Impulse is vrijgesteld van iedere aansprakelijkheid voor de niet-uitvoering, laattijdige uitvoering of gebrekkige uitvoering van haar verplichtingen als gevolg van overmacht of uitzonderlijke omstandigheden buiten haar wil. Dergelijke omstandigheden kunnen onder meer leiden tot de volledige of gedeeltelijke annulering of het uitstel van het evenement en Wild Impulse ertoe verplichten het evenement geheel of gedeeltelijk te annuleren.
Voor alle duidelijkheid worden onder meer als gevallen van overmacht beschouwd, zonder dat deze opsomming beperkend is: pandemieën en epidemieën, alsook alle maatregelen ter bestrijding daarvan die worden genomen door federale, gewestelijke, gemeentelijke, provinciale, openbare, administratieve of gerechtelijke autoriteiten, die bindend zijn voor Wild Impulse en gevolgen hebben voor de organisatie van het evenement.
Als gevallen van overmacht worden eveneens beschouwd, zonder dat deze opsomming beperkend is: overstromingen, brand, noodweer of weersomstandigheden van welke aard ook—zoals regen, wind, hagel, storm, onweer, bliksem, tyfoons, vochtigheid, hittegolven of extreme hitte—die het evenement kunnen onderbreken, wijzigen of annuleren, stakingen in het openbaar vervoer en aanbevelingen van het Coördinatieorgaan voor de dreigingsanalyse (OCAD) in geval van een aanslag of dreiging van een aanslag.
10.2 Wild Impulse verbindt zich ertoe de betrokkenen onmiddellijk in kennis te stellen van elke overmachtsituatie die een wijziging van het evenement vereist of de organisatie of uitvoering ervan onmogelijk maakt.
Wanneer de overeenkomst wegens overmacht wordt ontbonden en de ontbinding wordt meegedeeld, behoudt Wild Impulse zich het recht voor om de betrokken personen, in plaats van de prijs van hun tickets terug te betalen, een tegoedbon van dezelfde waarde aan te bieden, binnen de grenzen die door de toepasselijke wetgeving zijn toegestaan.
10.3 – Wijziging of vervanging van een discipline
Wanneer, om redenen buiten de wil van Wild Impulse, een of meer oorspronkelijk in het programma opgenomen disciplines niet kunnen worden georganiseerd of voortgezet onder bevredigende veiligheidsomstandigheden of overeenkomstig de toepasselijke vergunningen, behoudt Wild Impulse zich het recht voor om de betrokken discipline te wijzigen, in te korten, te neutraliseren of te schrappen en deze, voor zover mogelijk, door een andere activiteit of discipline te vervangen.
Hieronder vallen onder meer, zonder dat deze opsomming beperkend is: ongunstige weers- of natuuromstandigheden, droogte, een onvoldoende of te hoge waterstand, een ongeschikt waterdebiet, brandgevaar, de toestand of onbegaanbaarheid van routes, paden of wateroppervlakken, beslissingen of aanbevelingen van overheidsinstanties, terreinbeheerders of eigenaars, alsook de intrekking of wijziging van een vergunning die noodzakelijk is voor de organisatie van een discipline.
Wanneer het evenement desondanks doorgaat, vormt de wijziging, vervanging of schrapping van een discipline om een van deze redenen geen annulering van het evenement.
Een deelnemer die wegens een dergelijke wijziging, vervanging of schrapping beslist om niet aan het evenement deel te nemen, heeft geen recht op een volledige of gedeeltelijke terugbetaling van zijn inschrijvingsgeld, onder voorbehoud van de dwingende wettelijke bepalingen die op consumenten van toepassing zijn.
ARTIKEL 11 – NIETIGHEID
11.1 De onwettigheid of ongeldigheid van een van de bepalingen van deze algemene voorwaarden heeft geen invloed op de geldigheid van de overige contractuele bepalingen.
ARTIKEL 12 – GESCHILLEN – BEVOEGDHEID – TOEPASSELIJK RECHT
12.1 In geval van een geschil over de totstandkoming, interpretatie, uitvoering of ontbinding van deze algemene voorwaarden zullen de partijen trachten een minnelijke oplossing te bereiken.
12.2 De contractuele betrekkingen tussen de partijen waarop deze algemene voorwaarden van toepassing zijn, worden beheerst door en geïnterpreteerd overeenkomstig het Belgische recht.
12.3 De rechtbanken van het gerechtelijk arrondissement waar de maatschappelijke zetel van Wild Impulse is gevestigd, zijn bevoegd, onverminderd de rechten die de consument krachtens de toepasselijke wetgeving geniet.
ARTIKEL 13 – BESCHERMING VAN PERSOONSGEGEVENS (AVG/GDPR)
13.1 In het kader van de organisatie van evenementen en het beheer van inschrijvingen verzamelt en verwerkt Wild Impulse persoonsgegevens van deelnemers, waaronder hun naam, voornaam, e-mailadres, telefoonnummer en gegevens met betrekking tot hun deelname.
13.2 Deze gegevens worden verwerkt overeenkomstig Verordening (EU) 2016/679 van 27 april 2016, de Algemene Verordening Gegevensbescherming (“AVG/GDPR”), en de toepasselijke Belgische wetgeving.
13.3 De verzamelde gegevens worden uitsluitend gebruikt voor:
● het beheer van de inschrijvingen en de deelname aan evenementen;
● het verstrekken van informatie met betrekking tot het evenement;
● het administratieve en financiële beheer;
● de verbetering van de aangeboden Diensten.
13.4 Persoonsgegevens worden niet langer bewaard dan noodzakelijk is voor de doeleinden waarvoor ze werden verzameld, behoudens een andersluidende wettelijke verplichting.
13.5 Wild Impulse verbindt zich ertoe alle passende technische en organisatorische maatregelen te nemen om de veiligheid en vertrouwelijkheid van persoonsgegevens te waarborgen.
13.6 Persoonsgegevens worden niet aan derden doorgegeven, behalve wanneer dit noodzakelijk is voor de organisatie van het evenement, waaronder doorgifte aan technische dienstverleners en partners, of wanneer dit wettelijk verplicht is.
13.7 Overeenkomstig de AVG/GDPR beschikt iedere betrokkene onder meer over het recht op inzage, rectificatie, gegevenswissing, beperking van de verwerking, bezwaar en gegevensoverdraagbaarheid.

13.8 Iedere betrokkene kan een klacht indienen bij de Belgische Gegevensbeschermingsautoriteit.
ARTIKEL 14 – VEILIGHEID EN DEELNAMEVOORWAARDEN
14.1 Wild Impulse behoudt zich het recht voor om de deelname te weigeren of op elk moment een deelnemer uit te sluiten van wie het fysieke of technische niveau onvoldoende wordt geacht, van wie de uitrusting ongeschikt of niet-conform is, of van wie het gedrag de eigen veiligheid of die van andere deelnemers in gevaar kan brengen.
14.2 Bij uitsluiting om een van de in dit artikel vermelde redenen kan geen terugbetaling worden geëist, onder voorbehoud van de toepasselijke dwingende wettelijke bepalingen.
14.3 De deelnemer verbindt zich ertoe over alle voor het evenement verplichte uitrusting te beschikken, zoals gespecificeerd in de informatie die Wild Impulse vóór het evenement verstrekt.
ARTIKEL 15 – ERKENNING VAN DE RISICO’S EN VERANTWOORDELIJKHEID VAN DE DEELNEMER
15.1 De deelnemer erkent uitdrukkelijk dat de door Wild Impulse aangeboden activiteiten, waaronder trailrunning, packraften, mountainbiken en alle andere activiteiten in een natuurlijke omgeving, inherente risico’s inhouden die materiële schade, lichamelijk letsel, ernstig lichamelijk letsel of zelfs overlijden tot gevolg kunnen hebben.
15.2 Door zijn inschrijving te bevestigen, verklaart de deelnemer:
● in goede lichamelijke conditie te verkeren en geen bekende medische contra-indicatie te hebben voor de activiteiten waarvoor hij zich inschrijft;
● over de minimaal vereiste technische vaardigheden te beschikken;
● te kunnen zwemmen voor elke activiteit in een wateromgeving;
● zich bewust te zijn van de risico’s die inherent zijn aan dit soort evenementen.
15.3 De deelnemer aanvaardt de inherente en normaal voorzienbare risico’s die met zijn deelname verbonden zijn en erkent dat hij onder zijn eigen verantwoordelijkheid deelneemt wat betreft de gevolgen die voortvloeien uit zijn eigen gedrag, gezondheidstoestand, uitrusting of niet-naleving van de veiligheidsvoorschriften. Deze bepaling heeft niet tot doel of gevolg enige aansprakelijkheid van Wild Impulse uit te sluiten of te beperken die wettelijk niet kan worden uitgesloten of beperkt.
15.4 De deelnemer verbindt zich ertoe alle veiligheidsvoorschriften na te leven die vóór en tijdens het evenement worden meegedeeld, evenals de beslissingen van de organisatie, met name bij een wijziging van het parcours of het stopzetten van een activiteit om veiligheidsredenen.
15.5 De deelnemer erkent dat Wild Impulse zich genoodzaakt kan zien om een parcours of discipline geheel of gedeeltelijk te wijzigen, te onderbreken of te schrappen om veiligheidsredenen, overeenkomstig onder meer de bepalingen van artikel 10.
15.6 De deelnemer is verantwoordelijk voor zijn persoonlijke uitrusting en voor het materiaal dat Wild Impulse hem ter beschikking stelt. Hij verbindt zich ertoe dit overeenkomstig de ontvangen instructies te gebruiken en er redelijke zorg voor te dragen.
15.7 Door zijn online-inschrijving te bevestigen en deze algemene voorwaarden te aanvaarden, erkent de deelnemer kennis te hebben genomen van de inherente risico’s van de aangeboden activiteiten en van de veiligheidsverplichtingen die in dit artikel zijn vastgelegd.
